Facts
A Connecticut law required non-residents to pay higher tuition and fees at state universities than Connecticut residents. The law stated that a student’s residency status for tuition purposes was to be determined at the time of admission and could not be changed. Two students (plaintiffs) who were non-residents at the time of their admission brought suit to challenge the irrebuttable presumption of non-residence. The district court ruled for the plaintiffs. The defendant appealed.
