Facts
International Association of Machinists and Aerospace Workers (plaintiff) represented employees of Vulcan Iron Works Inc. (Vulcan) (defendant). Vulcan provided Thanksgiving turkeys to the employees for at least 20 years, until 1981. Vulcan and its employees had a collective-bargaining agreement (the agreement), which specifically stated that the agreement constituted the entire contract between the parties. The agreement did not include any provisions with regard to providing Thanksgiving turkeys to employees each year. The International Association of Machinists and Aerospace Workers filed a grievance against Vulcan and argued that Vulcan violated the agreement by not providing Thanksgiving turkeys to the employees in 1981.
