Facts
Rosaline Siek married John Siek (defendant) four months after making out a will dividing her estate among her mother, brother, nieces, and nephews. Shortly thereafter, John beat Rosaline to death. John was indicted for murder but pled guilty to manslaughter in the first degree. Wadsworth (plaintiff), the executor of Rosaline’s estate, brought an action for a declaratory judgment that John was precluded from receiving any of Rosaline’s estate because of John’s manslaughter conviction.
