Facts
Wagamama Limited (plaintiff) owned a restaurant serving Japanese cuisine, using the name Wagamama. Wagamama owned three trademarks consisting of the word Wagamama. In 1993, City Centre Restaurants PLC (Rajamama) (defendant) opened a chain of Indian-cuisine restaurants under the name Rajamama. Wagamama filed suit, claiming that Rajamama’s use of the Rajamama name caused confusion with the Wagamama trademarks and thus violated the United Kingdom’s 1994 Trade Marks Act.
