Facts
Several school districts in the state of Washington, including Odessa School District (Odessa) (defendant) adopted policies that any student wanting to participate in interscholastic athletics (as well as parents or guardians) were required to sign a standard form releasing the school district from “liability resulting from ordinary negligence” that could arise in connection with the school district’s interscholastic activities. Wagenblast (plaintiff) and several other students filed suit seeking an order declaring the releases invalid. The trial court held for Odessa and Wagenblast appealed.
