Facts
Kristina Wait (plaintiff) was an executive with the American Cancer Society (ACS) and worked from home. The ACS furnished Wait with office equipment, a dedicated business telephone line, and a budget for office furniture. Wait sometimes hosted meetings with coworkers at her home-based office but was not required to open her office to the public for any reason associated with her job. Wait had been working from home for nearly six years when one day, while preparing lunch in her kitchen, Wait answered the door to a neighbor who brutally attacked her. Wait was severely injured and filed a workers’-compensation claim that was denied by the ACS’s insurance carrier, Travelers Indemnity Company of Illinois (Travelers) (defendant). The trial court granted Travelers’ motion for summary judgment, and Wait appealed.
