In 1986, agents Norby Walters (plaintiff) and Lloyd Bloom (plaintiff) induced Brent Fullwood (defendant), a star running back for Auburn University, to enter into and sign a secret post-dated agreement for representation in exchange for immediate payment of $4,000 and a future payment for an additional $4,000. In the 1987 National Football League (NFL) draft, the Green Bay Packers selected Fullwood as the fourth pick. However, at the time of the selection, Fullwood had obtained different agent representation, repudiated his deal with Walters and Bloom and refused to repay any of the money he collected. Walters and Bloom brought suit against Fullwood in an effort to collect the $8,000 paid to him as well as the promised five percent commission on Fullwood’s Packers contract.
