Facts
The Trustees of Indiana University (the university) (plaintiff) filed a condemnation action against Wampler (defendant) seeking to condemn property owned by Wampler to build a parking lot for a student dormitory. Prior to filing its condemnation action, the university sought to purchase the property for $25,000. The university had previously purchased two neighboring properties for $18,000 and $21,000. Wampler rejected the $25,000 offer. The university then offered $30,000. Wampler countered by offering to sell the property for no less than $50,000. The university believed this price to be unreasonable, so the university filed a condemnation action. Wampler objected to the condemnation, alleging, among other things, that the university did not negotiate in good faith to purchase the land because the university did not offer what Wampler considered fair market value. The trial court rejected Wampler’s objections and appointed appraisers to assess the land for condemnation. Wampler appealed.
