Facts
Wana the Bear (plaintiff) is a direct descendant of the Bear People Lodge of the Miwok Indians. A burial ground of the Miwok was being excavated by Community Construction (defendant) in order to establish a residential neighborhood. Wana the Bear brought suit to enjoin Community Construction from the excavation. The lower court denied Wana the Bear’s request for an injunction. Wana the Bear appealed.
