Facts
Ward (plaintiff) sued Morr Transfer & Storage Company (defendant) for the conversion of items she stored at a company warehouse. Before trial, Ward made a note each time she remembered an item that had been in storage. Ward transcribed those notes onto a list which she consulted on the witness stand when asked to remember the items involved. The jury returned its verdict for Ward. On appeal to the Kansas City Court of Appeals, Missouri, Morr argued that Ward's use of the list was improper.
