Facts
Judith and Roger Warren (plaintiffs) visited the home of their neighbor, Joe Medley (defendant), after spending time at a nightclub where go-go dancers performed on a platform. Medley was entertaining John Reynolds III (defendant) at his home that evening. After the Warrens described the go-go dancers, Reynolds picked Mrs. Warren up against her will and placed her on a glass table, urging her to show them how the dancers performed. Medley knew that the table could not withstand the weight of an adult, but there was no possibility of stopping Reynolds. While Mrs. Warren begged to be taken down, the table broke and she was injured by glass shards. The Warrens sued Medley and Reynolds in a Texas state court. Medley moved for summary judgment, and the trial court granted a take-nothing judgment in his favor. The Warrens appealed the judgment.
