Facts
Richard Barry (defendant), a star basketball player, signed a contract with the Oakland Oaks professional basketball team. The Washington Capitols (plaintiff) then bought Barry’s contract from Oakland, but Barry entered into a competing contract with the San Francisco Warriors. Barry stated he did not want to leave California to play for the Capitols due to personal and financial interests. The Capitols sued for a preliminary injunction to enjoin Barry from playing professional basketball for any other team while he was in default under his contract with the Capitols.
