Facts
The Washington Metropolitan Area Transit Commission (plaintiff) received a permanent injunction banning Holiday Tours, Inc. (defendant) from operating a sightseeing service without a certificate of public convenience and necessity. The district court then granted Holiday Tours a stay of the injunction pending its appeal. The commission moved to vacate the stay, arguing that Holiday Tours had not shown that its appeal would probably be successful.
