Puget Sound Energy (PSE) (plaintiff) filed a proposed three-year rate plan with the Washington Utilities and Transportation Commission (commission). The plan sought to raise electric rates by $310.5 million the first year, $63 million the second year, and $31.8 million the third year. Such changes would increase the average cost across PSE’s customer base by approximately 13.59 percent the first year, 2.47 percent the second year, and 1.22 percent the third year. Several businesses and consumer organizations (organizations) (defendants) intervened to challenge the proposed plan. PSE entered settlement agreements with the organizations. The settlement agreements resulted in the proposal of an amended two-year rate plan that sought to balance the interests of PSE and its customers while still addressing the pressing issues of clean-energy implementation, power costs, and equity. Among other things, the amended plan required that PSE develop a management plan that incorporated equitable outcomes, conduct a study analyzing distributional equity, and increase its assistance program for low-income customers. The plan also included performance-based ratemaking that linked revenue and profits to certain performance outcomes. The commission considered whether to approve the amended multiyear rate plan.
