Facts
Rachel Wasserman (plaintiff) worked at Potamkin Toyota, Inc. After experiencing sexual harassment at work, Wasserman left her job and filed a lawsuit in federal district court against Potamkin Toyota and three of its employees (defendants) for alleged violations of Title VII of the Civil Rights Act of 1964 and the Pennsylvania Human Relations Act. Wasserman’s Pennsylvania Human Relations Act claims against Potamkin Toyota’s employees assumed that the act imposed personal liability on individual employees. The district court had federal-question jurisdiction over Wasserman’s Title VII claims. Potamkin Toyota and its employees argued that the district court should not exercise supplemental jurisdiction over Wasserman’s Pennsylvania Human Relations Act claims because Wasserman’s case presented a novel question of state law—whether the Pennsylvania Human Relations Act imposed personal liability on individual employees—that should be decided in state court.
