Facts
The United States Department of Defense (the military) (defendant) engaged in target practice on a base located on Vieques Island, Puerto Rico (the impact area). Munitions were fired and landed in the impact area or, occasionally, skipped off into surrounding water. Water Keeper Alliance (plaintiff) initiated a suit under the Resource Conservation and Recovery Act, seeking injunctive relief against the military. The military filed a motion to dismiss the claims based on the act.
