Facts
Peter Waweru (defendant) was convicted of the crime of discharging raw sewage into a public water source. Waweru appealed the conviction. On appeal, Waweru argued, among other things, that the prosecution was discriminatory because only a few of the many individuals who discharged sewage into the public water source were prosecuted. Waweru and other plot owners in the township also contended that they could not comply with the health requirements concerning the waste water and that the costs of having sewage treatment works in their respective plots would be prohibitive.
