Facts
The Boston Athletic Association (BAA) (defendant) formally registered the words “Boston Marathon” in connection with the road race and granted an exclusive license to WBZ-TV to telecast the race. Nevertheless, a competing station, WCVB-TV (plaintiff), televised the marathon along the route and from helicopters while regularly using the words “Boston Marathon” before, during, and after the race. The BAA brought suit against WCVB-TV in federal district court alleging violations of trademark law. The district court held for WCVB-TV and the BAA appealed.
