Facts
Jamie Webb, Jeffrey Hermanson, and Michaleen Jeronimus (bicyclists) (plaintiffs) were completing a long-distance bicycle ride on Gregory Street in Black Hawk, Colorado (city) (defendant). The bicyclists were pulled over and ticketed for violating the city’s municipal code, which prohibited bikes on Gregory Street. The bicyclists sued the city, alleging that the ordinance was preempted by state law.
