Weber v. U.S. Sterling Securities
Connecticut Supreme Court
924 A.2d 816 (2007)

- Written by Rich Walter, JD
Facts
U.S. Sterling Securities, Inc. (Sterling), Michelle Orr, and Shawn Orr (defendants) sent unsolicited telemarketing faxes on behalf of Retail Relief, LLC, a limited-liability company. After receiving some of these unwanted faxes, Aharon Weber (plaintiff) sued Sterling and the Orrs for violating a federal statute that prohibited such transmissions. Sterling and the Orrs responded that, as members and officers of Retail Relief, they could not be held personally liable for Retail Relief’s debts or liabilities. The trial court accepted this defense and entered summary judgment for Sterling and the Orrs. Weber appealed to the Connecticut Supreme Court.
