Facts
Rogers was critically ill when she entered a hospital. Despite Rogers’ condition, Dr. Lee and the hospital (defendants) checked Rogers into a “regular” room. Rogers died shortly thereafter, and her children, the Wiegels (plaintiffs), brought a wrongful death action against Lee and the hospital. The Wiegels sought damages for their own emotional distress and loss of parental consortium. The trial court ruled that the Wiegels did not have a cause of action for the requested damages and dismissed the case in favor of Lee.
