Facts
The Federal Trade Commission (FTC) (defendant) conducted investigations into the weight-loss industry. Weight Watchers International, Inc. (Weight Watchers) (plaintiff) believed that the FTC was improperly regulating the weight-loss industry and petitioned the FTC to regulate the industry through rulemaking. The FTC denied Weight Watchers’ rulemaking petition. Weight Watchers filed a lawsuit in federal district court, seeking review of the FTC’s denial pursuant to § 704 of the Administrative Procedure Act. Section 704 provided for review of final agency actions. The district court dismissed the case, holding that Weight Watchers’ case was not ripe for review, because the FTC had not issued a final order against Weight Watchers. Weight Watchers appealed.
