Facts
Weisz and other buyers (plaintiffs) attended an art auction conducted by Parke-Bernet Galleries, Inc. (gallery) (defendant). The paintings the buyers purchased were ascribed by the auction catalogue to the hand of a particular artist. In fact, the paintings were forgeries. The catalogue’s introduction, which described how the auction would be conducted, prominently disclaimed any warranty that the catalogue’s ascriptions of authorship were accurate in every case. The trial court entered judgment for the buyers, and the gallery appealed to the New York Supreme Court, Appellate Term.
