Facts
The State of Alabama (plaintiff) prosecuted Weldon (defendant), a city tax collector, for larceny. The evidence showed that Weldon withheld payments owed to the city and converted the money to his own use. Although the judge did not instruct the jury as to the elements of the crime, the jury convicted Weldon of larceny. Weldon appealed to the Court of Appeals of Alabama.
