Facts
Vernon White (plaintiff) was riding the school bus home from school. The bus driver stopped to let White get off. The road on which the driver stopped had one traffic lane and two parking lanes on either side of the traffic lane. White descended from the bus and needed to cross in front of the bus and across one of the parking lanes go get to his home. The driver initially saw no traffic through the rear-view mirror, and he signaled White to cross. The driver checked the mirror again and saw that a car had started to drive in the parking lane. The bus driver was unable to warn White of the car, and the car struck and ran over White. White, through his mother, brought a tort action against the school district (district) (defendant), seeking to hold the district liable for White’s injuries. The trial court granted summary judgment for the district, holding that the district was immune from suit under Pennsylvania’s Tort Claims Act. The appellate court reversed, and the district appealed to the Pennsylvania Supreme Court.
