White v. Atlantic City Press
New Jersey Supreme Court
313 A.2d 197, 64 N.J. 128 (1973)
- Written by Serena Lipski, JD
Facts
John B. White (plaintiff) worked as a route delivery driver for Atlantic City Press (defendant), delivering newspapers near Atlantic City. One morning, White was driving to his route when he picked up two hitchhikers who said they needed to go to the bus station. Driving the hitchhikers to the bus station would not have taken any longer than White’s normal route in the morning. The hitchhikers attempted to rob White at knifepoint, stabbing him several times as White fought to get away. The hitchhikers were arrested, and White was hospitalized for stab wounds. White filed a claim for workers’ compensation. White was denied benefits, and he appealed.
