Facts
Loretta and Charles White (plaintiffs) owned a home that was damaged in a fire. The fire occurred while the city’s fire department was on strike. During the strike, the firefighters’ union, International Association of Firefighters, Local 42 (the union) (defendant), refused to respond to fire alarms or calls, established picket lines, and sabotaged fire equipment. Missouri law explicitly prohibited strikes by public unions. The Whites alleged that the fire was not brought under control because of inadequate equipment and inexperienced personnel. The Whites filed suit against the union. Count 1 of the Whites’ complaint was predicated on a violation of the state law banning public-union strikes, and Count 2 asserted that the union’s conduct established the tort of outrage. The trial court granted the union’s motion to dismiss for failure to state a claim on which relief could be granted.
