Facts
Emma White (plaintiff) was in her father’s house when F. H. Sander (defendant) approached the house from outside and threw a rock through a closed window. White suffered personal injuries from the fright. White brought suit against Sander. Sander revealed that he intended to injure only the house because he had a dispute with White’s father. He did not know that White was in the room where he threw the rock. The court found in favor of White. Sander appealed.
