Facts
Angela White (plaintiff) sought to become a firefighter and paramedic for the Homewood Fire Department. In order to become a firefighter and paramedic, applicants were required to perform a physical-agility test. White signed an exculpatory agreement releasing Homewood from any claims that might arise out of the physical-agility test. White was injured while performing the test and sued the Village of Homewood (Homewood) (defendant) for negligently administering the test. Homewood moved to dismiss the claim based on the exculpatory agreement. The trial court granted the motion to dismiss, and White appealed to the Illinois Appellate Court.
