Facts
Members of the executive board (board members) (defendants) of the Greater Ministries International Church ran a program through the church that fraudulently took in over $400 million from investors. The board members were charged with conspiracy to launder money, in violation of 18 U.S.C. § 1956(h). After trial, the board members sought a jury instruction requiring a finding that at least one of the coconspirators had committed an overt act in furtherance of the conspiracy. The district court denied the board members’ request, and they were convicted. The Court of Appeals for the Eleventh Circuit affirmed. Certiorari was granted.
