Facts
Anglum (defendant) contracted to sell 175 quarts of milk to Whitman (plaintiff) every day for a year. The contract required Whitman to pick up the milk each day at Anglum’s farm. About seven months into the contract, the state commissioner of domestic animals ordered a quarantine of Anglum’s farm due to an outbreak of hoof-and-mouth disease on the farm. The quarantine did not make it illegal to deliver milk, generally. As of the date of the quarantine, Anglum ceased providing milk to Whitman for about four months. Whitman sued Anglum for breach of contract. The trial court ruled in favor of Whitman. Anglum appealed, arguing that the quarantine excused his performance.
