Facts
In March 2011, President Barack Obama (defendant) authorized a military mission to support the United Nations Security Council’s Resolution 1973 (2011), which aimed to stabilize Libya and stop the Qaddafi-regime forces from attacking Libyan civilians. After Libyan leader Muammar Qaddafi’s death and the defeat of the Qaddafi-regime forces, the United States ended the military operations in support of the mission. Mark Whitney (plaintiff) then filed an action against Obama for declaratory and injunctive relief, alleging that Obama had acted beyond the authority granted to the president under the War Powers Resolution. Obama filed a motion to dismiss on the ground that the case was moot.
