Facts
David Whittlesey (defendant) crashed his car into the car Stewart Miller was driving. Whittlesey agreed to pay $9,650 to Miller to settle his claim and obtain a release. Whittlesey and Miller entered into a settlement agreement with those terms. A few months later, Ann Miller (plaintiff) sued Whittlesey, alleging negligence and seeking damages for loss of consortium. The trial court granted summary judgment to Whittlesey, ruling that Texas did not recognize a claim of loss of consortium filed by a wife. Ann appealed, and the court of appeals reversed. Whittlesey appealed to the Texas Supreme Court.
