Wi-LAN, Inc. (plaintiff) sued Sharp Electronics Corporation (Sharp) (defendant) for patent infringement. At trial, Wi-LAN sought to introduce an unauthenticated source-code printout. The trial court excluded the source code as hearsay. Wi-LAN’s expert witness wrote a report concluding that Sharp’s television infringed Wi-LAN’s patent. The expert based his opinion on the unauthenticated source-code printout. Wi-LAN argued that under Federal Rule of Evidence 703, the source-code printout was admissible because it served as the basis for its expert’s opinion. The trial court excluded the source code and granted Sharp’s motion for summary judgment. Wi-LAN appealed.
