Facts
Wickham & Burton Coal Co. (Wickham) (plaintiff) and lumber company Farmers’ Lumber Co. (Farmers’) (defendant) entered into an oral agreement whereby Wickham agreed to provide Farmers’ all the coal Farmers’ required at a specified price. Farmers’ filed a counterclaim because it was forced to purchase coal on the open market at a rate higher than the contract rate, seeking the difference between the market price and the contract price. The trial court overruled Wickham's demurrer to the counterclaim. Wickham appealed to the Iowa Supreme Court.
