Facts
A wife and husband (plaintiffs) sued the wife’s treating doctor (defendant), a diagnostic and therapeutic-radiology specialist, for medical malpractice based on a theory of lack of informed consent. The wife was injured from radiation treatments administered to her by the doctor. The trial judge ruled that informed consent was inapplicable to the claim and granted the doctor’s motion for a directed verdict. The husband and wife appealed.
