Facts
Inglis and four other baking companies (plaintiffs) filed an antitrust action under the Sherman Act and moved for a preliminary injunction against ITT Continental Baking Co. (ITT) (defendant) and others, which was denied by the district court. The motion contended that the defendants discriminatorily priced their private label bread products at below cost. ITT responded that they established their prices in a good faith effort to meet competition, which was a defense to the statute under which the injunction was sought.
