Williams v. MBNA America Bank, N.A.
United States District Court for the Eastern District of Michigan
538 F. Supp. 2d 1015 (2008)
- Written by Sheri Dennis, JD
Facts
Kim Williams (plaintiff) applied to MBNA America Bank, N.A. (MBNA) (defendant) for a credit card. Williams provided MBNA with her credit information. Based on this information, MBNA denied Williams’s application. MBNA sent Williams a letter stating that her application had been denied because (1) she had sufficient balances on her revolving credit lines, and (2) she had sufficient credit available based on her income. Williams sued MBNA, alleging that the reasons provided by MBNA were incoherent and thus in violation of the notice requirement under the Equal Credit Opportunity Act (Act), 15 U.S.C. § 1691(d). MBNA moved to dismiss the claim.
