Facts
Williams (plaintiff) was a security guard at a restaurant. Williams had a two-way portable receiver manufactured by RCA Corporation (RCA) (defendant) to seek assistance from local police in the event of a security incident. Somebody tried to rob the restaurant, and Williams radioed for help with his RCA receiver. The RCA two-way radio was defective, and Williams was unable to call for backup. Williams attempted to arrest the robber on his own, and the robber shot him. Williams brought suit against RCA, claiming that the defective radio was the proximate cause of his injury. The trial court granted RCA’s motion to dismiss. Williams appealed.
