Macon Telegraph Publishing Company (Macon) (defendant) had a hiring policy that prohibited long hair on men but allowed long hair on women. Alan Willingham (plaintiff), a man with long hair, applied for a job at Macon. Macon refused to hire Willingham due to the length of his hair. Willingham brought suit, contending that Macon’s hiring policy discriminated on the basis of sex in violation of Title VII of the Civil Rights Act of 1964 (Title VII). The district court granted summary judgment in favor of Macon. Willingham appealed.
