Wilson v. Firkus
United States District Court for the Northern District of Illinois
457 F. Supp. 2d 865 (2006)

- Written by Sean Carroll, JD
Facts
Robert Wilson (defendant) was charged with attempted murder after he attacked a woman with a box cutter at a bus stop. Wilson initially confessed to the crime, but there was no physical evidence linking him to the crime. Less than one hour after Wilson was arrested, an attack with a similar modus operandi occurred six blocks from where the original attack occurred. Over the next two weeks, four more stabbing attacks occurred within a mile and a half. Jerryco Wagner was arrested for these other five attacks. Wagner admitted to committing these other attacks. At Wilson’s trial, Wilson sought to introduce evidence about Wagner and the other attacks. The trial court excluded the evidence, finding that it was not relevant. Wilson was convicted, and he filed a petition for writ of habeas corpus.
