Facts
Tess Wiltz (plaintiff) purchased crawfish from crawfish farmers and then sold the crawfish or repurposed the tail meat. Crawfish are farmed in rice ponds. In 1999 and 2000, crawfish farmers in the area used rice coated with a harmful pesticide from Bayer Cropscience, Limited Partnership (Bayer) (defendant). The harmful pesticide caused a decline in the crawfish supply in 1999 and 2000. This resulted in a supply interruption to Wiltz’s business. Wiltz brought suit against Bayer for the supply interruption. The trial court granted summary judgment in favor of Bayer. Wiltz appealed.
