Facts
William Wineberg (plaintiff), a resident of Washington state, purchased real property located in California from O. O. Barker. Wineberg did not record his deed until three years after the purchase. Between the time of Wineburg’s purchase and the recording of his deed, Barker executed and recorded a timber sale contract with Construction Engineers. Barker subsequently sold the same property to Natural Resources, Inc. and recorded the deed prior to the recording of Wineberg’s deed. In addition, several creditors acquired judgment liens against the property prior to the recording of Wineberg’s deed. Wineberg filed a quiet title suit naming Moore, Construction Engineers, Natural Resources, Inc. and several judgment creditors as defendants.
