Facts
Charlotte Smallwood (plaintiff) worked for a grocery store operated by Winn-Dixie Stores (Winn-Dixie) (defendant) in Russellville, Alabama, where she also lived. Smallwood had worked at the Russellville store for five years when she was told she would be working on a three-day temporary assignment at a Winn-Dixie store in Moulton, Alabama, which was 30 miles from Russellville. Winn-Dixie instructed Smallwood to meet another employee at the Russellville store so that they could carpool to Moulton together each day. Smallwood was not paid for her time commuting from Russellville to Moulton. On the way back to Russellville after her last day of working in Moulton, Smallwood was injured in a car accident. Smallwood filed a claim for workers’-compensation benefits. Winn-Dixie argued that Smallwood’s injuries did not arise out of and occur during her employment. The trial court granted summary judgment in Smallwood’s favor, holding her claim was compensable. Winn-Dixie appealed.
