Facts
Winner Wetten GmbH (WW) (plaintiff) sought to start a sports-betting business in Bergheim, Germany. WW had a sports-betting business in other European Union (EU) countries. However, pursuant to a German law providing a public monopoly on sports gambling, Bergheim’s mayor (defendant) refused to permit the business. WW challenged the mayor’s decision in a German court, contending that the German law was unenforceable, as it was incompatible with EU law, which allowed for the expansion of gambling establishments across member states. The German court referred the issue of whether EU law or national law prevailed to the European Union Court of Justice (EUCJ).
