Facts
G.P. Putnam’s Sons (Putnam) (defendant) published a book called The Encyclopedia of Mushrooms. Putnam did not write or edit the book. Winter et al. (plaintiffs) went mushroom hunting and used the book to decipher which mushrooms were safe to eat. Relying on the book, the plaintiffs ate certain mushrooms and became critically ill. The plaintiffs brought suit on theories of products liability and negligence. The trial court granted Putnam summary judgment. The plaintiffs appealed.
