Facts
Bessie Winterowd (plaintiff) visited the Lagoon Resort, a property owned by A. C. Christensen (defendant). Winterowd visited a baseball park located on the resort property. As Winterowd was walking to the baseball stands, a loose floorboard gave way and Winterowd fell. Winterowd’s leg went through the floor, and Winterowd suffered a series of injuries. The floors were rotten, decomposed, and wet at the time of the incident. Winterowd brought a negligence suit against Christensen. The lower court found in favor of Christensen. Winterowd appealed.
