Facts
Nigerian immigrants including Ken Wiwa (Wiwa) (plaintiffs) sued Royal Dutch Shell Petroleum Company (Royal Dutch) and Shell Transport and Trading Company (Shell) (defendants) in the United States, seeking to recover damages for alleged human-rights violations in Nigeria. Wiwa’s claims were brought under the Alien Tort Statute, also known as the Alien Tort Claims Act (ATCA), and the Torture Victim Prevention Act (TVPA). Royal Dutch and Shell motioned to dismiss the action on forum non conveniens grounds. The district court granted the motion. Wiwa appealed.
