Facts
According to the allegations of a complaint, Sarah Wodonos (defendant) got married, and later that year, Sarah’s father, Jose Singer (defendant), conveyed a 25 percent interest in a Miami Beach property to Sarah and Sarah’s husband (plaintiff) together as a gift for their use and benefit. As alleged, however, title to the property was placed in Sarah’s name alone. Thereafter, Sarah and Singer refused to honor the purported trust or acknowledge Sarah’s husband as a beneficiary. The husband sued Sarah and Singer, seeking the court’s imposition of a constructive trust. The supposed trust created by Singer was not evidenced by a written document, nor was the deed transferring ownership to Sarah included in the court’s file. The trial court dismissed the action with prejudice, and Sarah’s husband appealed.
