Facts
Ralph Wolff (plaintiff) sued Laverne, Inc. (defendant), seeking payment for work, labor, and services. A justice sitting at the supreme court’s pretrial term set the case for trial at the head of the next trial term’s general jury calendar. The justice did so while participating in settlement discussions in response to Laverne’s refusal to agree to pay an additional $1,000 to settle the case. Laverne moved to vacate the advancement of the trial date, which the supreme court denied. Laverne appealed.
